CHPSC - Rules (section 35 Byelaws)
Clwb Hwylio Pwllheli Sailing Club – Rules (Updated and Approved by MC on 30/01/2018)
Clwb Hwylio Pwllheli Sailing Club (CHPSC) is a members’ club limited by guarantee and is a Community Amateur Sports Club (CASC).
Section 35 of the ‘Articles of Association’ enables the Officers and Management Committee of CHPSC to issue Byelaws ‘Rules’ for the proper conduct, management and governance of the Club and these will be applied for the benefit of the members; individually and collectively.The Officers will, from time to time, review these ‘Rules’ as found necessary with changing circumstances.
Membership of CHPSC is from 1st January to 31st December and must be renewed annually
Applications and renewals of CHPSC membership is on-line, on the members section of the CHPSC web site.
Membership of CHPSC is open to everyone, without favour or discrimination.
The fees and entry fees (if any) will be set by the Management Committee annually
The Management Committee can, at its discretion, change the membership Categories as it finds necessary with changing circumstances.
Annual subscriptions relate to the calendar year and if not paid within one month of becoming due are deemed to be in arrears and membership status, and benefits, will be withdrawn.
Membership is personal to the member and it cannot be assigned or delegated to another person.
A cashless point of sale system operates for Bar purchases which Members are requested to use by making prior deposits of money on to their membership card.
The card should always be presented at the till to enable a discount to be applied. A discount will only be applied if a valid card is presented at the time of purchase and that the membership status has been confirmed by CHPSC to Plas Heli and to the Franchisee. (this could take a few days so please pay your membership fees in advance of your visit to ensure a discount on your purchase)
The card must not be passed on or shared with non-members, for any purpose, and especially not for receiving club members' discount.
A person who has been rejected as a candidate for membership or expelled under the rules of the Club will not be allowed club membership benefits.
House Rules
Members of CHPSC, their guests and visitors must abide by the ‘House and Licencing Rules’ published from, time to time, by Plas Heli the operating company for the Welsh National Sailing Academy and Event Centre or the Franchisee.
The Articles of Association set out the process for the election of the Flag Officers and Management committee, together with the conduct of meetings including the Annual General Meeting.
Section 35 byelaws ‘The Rules’ can be amended or repealed, by the CHPSC Management Committee by majority vote, as they consider necessary or expedient or convenient for the proper conduct and management of the Club.
The ‘Rules’ must be consistent with our Memorandum and Articles and must not be in breach of any statutory provision.

Members may use the carpark
Use of the facility is entirely at their own risk and implicitly accept:- The Club or Plas Heli will not accept any liability for personal injury arising out of the use of any of the facilities or out of participation in any race, cruise social event, other any other events organised by the Club either sustained by members, guests or visitors, whether or not such damage or injury could have been attributed to or was occasioned by the neglect, default or negligence of any of the officers, committee or servants of the Club.

Members shall not personally reprimand Plas Heli or Franchisee staff.

CHPSC - Rules 2018 (section 35 Byelaws)

The club was formed by Memorandum of Association 1960 (Memorandum). This sets out the objects for which the company was established, principally ‘to promote and further the sport of yachting and sailing, amongst members, in Cardigan Bay’ (3a)
The Articles of Association (Articles) sets out how the company will fulfil the objectives set out in the Memorandum. The Articles have been revised many times and was replaced in its entirety in 2003. There have been some subsequent minor amendments/additions to the Articles by ‘Special Resolutions’. An example was a Special Resolution at the AGM in 2010 to allow electronic communications with members. The Memorandum, Articles and Special Resolutions are registered with Companies House.
Section 35 of the Articles enables the Management Committee to ‘... make, alter and repeal any byelaws they consider necessary or expedient or convenient for the proper conduct and management of the Club’ BUT may not be inconsistent with our Memorandum, Articles or in breach of any statutory provision.

CHPSC moved to our new home in Plas Heli, the Welsh National Sailing Academy and Events Centre in July 2015. This move happened in the middle of a very busy summer.
There has been a lot of changes in the way we operate in the new environment and it is important that we listen to the opinions of our customers so that we can improve the service and experience for the benefit of all of our members, visitors and guests.

CHPSC, as a Not for Profit organisation is deamed to be excempt from notification under the provisions of the Data Protection Act 1998.
CHPSC must however comply with the provisions of the 1998 Act.
The eight data protection principles are:
(a) at least one of the conditions in Schedule 2 is met, and
(b) in the case of sensitive personal data, at least one of the conditions in Schedule 3 is also met.
Members of Clwb Hwylio Pwllheli are asked to make the following positive declaration as part of the Membership application form:
I consent to the above details being kept on the CHPSC computer and paper files (as set out in our data- protection policy) for the purpose of contacting me, receiving relevant information from the Club, receiving Club e-newsletters, for delivery of annual calendar, renewal requests and the administration of your club membership discount entitlement by Plas Heli.
